Terms of use
This translation is provided for convenience. In case of difference, the French version prevails.
1. Purpose
These terms of use (the “Terms”) govern the use of the Siyana app and of the siyana.org website. Siyana lets imams and speakers record and publish sermons, lectures, classes and reminders, and lets listeners listen to them.
Siyana is published by Farid Laadjel, sole trader (see the legal notice). In these Terms, “we” means Siyana and its publisher.
Using Siyana means accepting these Terms and the Siyana charter, available in the app (Help & support) and on this website. If you disagree, please do not use the app.
2. Definitions
- User: anyone using Siyana, with or without an account.
- Listener: a user who listens to and reads content.
- Publisher: an imam or speaker (lecturer, teacher, association) whose account has been approved and who can publish.
- Content: any audio or text published on Siyana (sermon, lecture, class, reminder), with its information (title, description, topic, language, references).
3. Access and accounts
- Creating an account is reserved for people aged 15 or over. Below that age, Siyana is used only with a parent, under their responsibility.
- Listener accounts are free. Without an account, use is limited.
- You agree to provide accurate information and to keep your sign-in details confidential. Any action taken from your account is deemed to be taken by you.
- The app is provided as is. We do our best to keep it available and reliable, without being able to guarantee it will be free of interruptions or errors.
4. Imam and speaker accounts
- Every publisher account request is reviewed and approved manually by our team. We may ask for supporting documents, contact the mosque or organisation given, and refuse a request without having to justify it.
- Every imam is linked to a guarantor mosque, which vouches for his identity and role. Imam accounts are reserved for men.
- Before his first publication, every imam goes through a compulsory training mode.
- An imam can ask to switch to a speaker account. A speaker account can never become an imam account again.
- We may suspend or withdraw the approval of a publisher account under the conditions of section 7.
5. Publishing rules
By publishing on Siyana, every publisher agrees to:
- publish only their own words, or content for which they have the author's consent;
- provide accurate information: title, topic, date, mosque, language and references cited;
- respect French law and the Siyana charter;
- use the “sisters only” label only for content truly suited to it. Only women speakers can use it; it is mandatory for a Quran recitation, tajweed or memorisation published by a woman speaker.
The following are strictly prohibited:
- any call to hatred, violence or discrimination against anyone;
- any statement contrary to French law;
- defamation, insults and attacks against named individuals;
- partisan political propaganda, including calls to vote for a candidate or party;
- publishing someone else's content without their consent;
- advertising and commercial promotion, except for the single link each publisher may add to their profile;
- any content unrelated to Siyana's purpose.
Each publisher is solely responsible for the content they publish.
6. Use of content by listeners
- Content is made available for personal listening and reading, in the app.
- It is forbidden to record, copy, cut or redistribute content outside Siyana without the author's consent.
- A share link only opens the Siyana app. Each publisher can disable link sharing, content by content.
- Content downloaded for offline listening stays in the app and cannot be transferred.
- Content reserved for sisters is only offered to women users.
7. Reporting, moderation and sanctions
- Any content can be reported from the app, with a reason. A person can only report the same content once. Reports must be made in good faith.
- Every report is reviewed by a member of our team; no sanction is ever taken automatically by an algorithm.
- When reports about a publisher become significant, they are informed, without ever knowing the identity of those who reported.
- In the event of a breach of these Terms or the charter, we may, depending on the seriousness of the facts: remove the content, send a warning, temporarily suspend the account or close it permanently. In serious cases, the guarantor mosque of the imam concerned is informed.
- We promptly remove any manifestly unlawful content brought to our attention, and may pass it on to the competent authorities where the law requires.
- Anyone subject to a sanction may ask for explanations and challenge the decision from the “Help & support” section of the app or at contact@siyana.org.
8. Ownership of content
- The publisher remains the owner of their content. Siyana acquires no ownership rights over it.
- By publishing, the publisher authorises Siyana, free of charge and worldwide, to host, store, technically convert and distribute their content in the app and through its share links, solely to operate the service. This authorisation ends when the content is deleted, subject to section 10.
- The publisher guarantees that they hold the necessary rights over what they publish, and that publishing it infringes no one's rights.
- The Siyana name, its logo, the app and the website remain the property of their publisher. Any reproduction without permission is forbidden.
9. Subscription and Sadaqa
- Listening is free for listeners. Siyana shows no advertising.
- Publishing by imams and speakers is subject to a yearly subscription. Its amount, payment terms (in one go or in instalments) and applicable conditions are shown in the app before any payment.
- Payments are handled by a specialised provider. Siyana holds no bank data.
- Any user can give Sadaqa: paying all or part of an imam's or speaker's subscription on their behalf. Sadaqa is used only for this, gives no right to anything in return and is never shown publicly. It is no longer offered once the year's subscription is fully funded.
- Published content is never removed solely because the subscription is no longer paid.
- Siyana accepts no donations for itself.
10. Deleting content and accounts
- Every publisher can freely delete their content, at any time.
- A listener can delete their account at any time from the app; deletion is immediate.
- An imam or speaker chooses, when making the request, between closing their account and leaving their content (it remains available, and their profile shows that the account is closed) or deleting everything (account, content, series and public profile). The request takes effect 28 days later; until then, simply signing back in cancels it. Reminder messages are sent during this period.
- Content under review following a report is removed from public view but kept in a protected area, inaccessible to users, for up to 90 days, then permanently deleted.
- In the event of the death of an imam or speaker, their content remains published. Their family may, on presenting proof, ask for it to be removed and the account closed, or kept with a discreet mention on their profile.
- To delete an account without the app, see the dedicated page.
11. Liability
- Siyana hosts the content published by publishers and is not its author. It takes no side for any movement, mosque or speaker.
- Publishers are responsible for the content they publish and the information they provide. Listeners are responsible for the way they use the app.
- The link a publisher adds to their profile leads to an external website, whose content is the sole responsibility of its author.
- We cannot be held liable for temporary unavailability of the service, for the loss of data stored only on the phone (drafts, downloads), or for use of the app contrary to these Terms.
12. Personal data
The processing of your data is described in our privacy policy.
13. Changes to the Terms
These Terms may evolve with the app. Each new version is dated. In the event of a significant change, you will be informed in the app; continuing to use Siyana means accepting the new version.
14. Governing law and disputes
These Terms are governed by French law. In case of difficulty, please write to us first at contact@siyana.org: we will look for an amicable solution. Failing that, the dispute will be brought before the competent courts under the ordinary rules of law.
